Each state has a state licensing board for hair dressers, barbers, dentists,doctors and everything else that requires a state license. Look for in your state scgilland Iowa's State Board of Cosmetology. Better yet here is the websitehttp://www.idph.state.ia.us/licensure/board_home.asp?board=cos If you go there and then go to the drop down box to laws and regulations you will find the exact laws and this:
Impose civil penalties not to exceed $1000. That is in Iowa. Each state laws are slightly different but from what I read of Iowa's laws are pretty tough sounds like you can't do anything outside a salon or licensed school unless you can prove the person your working on is disabled or dead. In Missouri you can work outside but if your not licensed you can tie thing into the hair if you don't use combs or brushes but even temporary colors and weaving and braiding are no no's. Remember just like that mother that thinks she can face paint because she puts on makeup every morning just because we may style and color our own hair doesn't mean we still don't need to train to do some else's hair.

Well, now I am seriously concerned, cause it says applying makeup also, so do I now have to have a cosmetology license to do my face painting? I have done this for almost a full year and have never been fined or told about this, do most of you think that they are lax on those laws for us unlicensed face painters?

I guess face painters aren't considered cosmetologists because I just got my business license two weeks ago and they didn't state that I need certification. My business license is under the category personal affairs management.

there is no certification required to do face painting anywhere... even in Alberta where their rules on equipment sanitizing is the strictest. I recommend getting entertainer's insurance (you can get it through WCA I believe in the USA) because you never know what can happen, but you don't need to be licensed through any certification board as a face painter.

As far as hair goes, we don't need to agree with the law, just follow it.... why anyone would need to be a licensed cosmetologist to be able to braid someone's hair is beyond me. I braid my daughter's hair all the time, hope I don't get fined! LOL

I hope I don't get fined for braiding my own hair. But in my region you have to commit a certain amount of hours of training under a licensed person of the profession you're pursuing. You also have to pay a few extra fees. http://dlca.vi.gov/boardcertifications/steps/barbers/

But so many people braid hair under the table. It's really for people that want to open a barber shop or hair salon.

It's that you charge to braid someone else's hair that trips the law. The makeup application thing is because of the big cosmetic companies. Mary Kay reps and Lancome and Clinque doesn't hire licensed people to apply their produce. That in combination with until the last 10 to 15 years most face painters used acrylics made that part of the law like the former don't ask, don't tell rule in the military. Because these big company control the industry and don't want to spend the extra money to hire someone licensed it won't change. I do know the Missouri board examiner came to Branson 5 times in 3 months to catch the unlicensed braider that was charging. Also most cosmetologist don't do that much makeup applications because that just not where they think the money is. Just like we have spent alot of money and time on our kits and training so have cosmetologist so we need to respect each other. Opening roads of respect with your local stylist can always lead to good free marketing because don't we all tell our hairdresser when we're going to have a party.

A major concern is lice and scabies, my grandchild attended a "Princess Party" done by one of my competitors ( she is a friend of my daughters), a woman owning the largest daycare in the areas was attending the party. Next day she turned the performer in for brushing kids hair in up dos and putting makeup on them. This was in the state of MD, so you don't know WHO will be watching so make sure what you are doing is Ok in your locale.
It is difficult when you're just trying to make a living, but some of the regulations are for real health reasons. It was explained that the daycares have unbelievable standards to meet and must use different combs and brushes on each child plus meet difficult hygiene standards. Thankfully we have the internet so we can find information.

I'm wondering about getting the sprays and you would never touch their hair, for lice though, not much protection as long as your in the same room you are at risk!

Yes you can not use the same comb on different people unless it is sanitized with barbacide in between each person. Brushes most be cleaned between people. If a comb,brush, or clip is dropped on the floor it must not be used again till sanitized. If you see signs of lice work must stop and everyone in the room must be checked and everything wiped down with bleach or sanitizer depending on the surface. Brushes and combs must be stored when not in use with dry sanitizer (formaldehyde). When I first started face painting I used barbacide to sanitize my paint brushes but was so glad I didn't have to deal with formaldehyde it's very dangerous stuff.
