Question, If I paint a child and then get verbal permission from the parent to take a pic for future use in advertising, is this enough? Do I need a release form, am I responsible if someone else uses it, I feel like I am stepping in to murkey waters. I have never posted anothers work trying to claim it as my own... I have used others ideas or creations as inspiration and ran with them... I watched so many ppl paint a tiger that I no longer know if mine is Mark reid inspired, LJY inspired or you tube inspired. I do tell ppl who want exactly that.... No two of my paintings will ever be the same. Every persons face shape is different and I go from there. I feel that If you did not paint it you should not use it for personal gain. There will always be those who feel the need to bend the rules until they break them. I think in the end as a painter you need to be able to provide your customer/client with accurate and realistic examples of your work. I have 2-5 and 10 min options. I will show you what you will get. I will not show someone a Butterfly that takes 10 min if I am given less time per child.... I am new and just now getting a business started but I feel that in thee end if you are honest, and represent yourself as you are then you will go far... At least I hope this works. I will follow my heart and place my trust in God to guide me....

Martha, just out of curiosity, why are you continuing to insult me? I apologized for making remarks that ended up being close to home for you. You're not going to convince me that copyright infringement is the same as theft. I'm not going to convince you that accusing people of crimes they haven't committed is likely to get you sued. We agreed to disagree, so what's up with the ongoing nastiness?

It's safest to get a signed release. That way there's no question. If you need a form, I believe Shannon and some other people have them on their websites. You don't have to reinvent the wheel and make your own. You are NOT responsible if someone copies the photo for their own use.

You know, it's usually not. Tempers are kind of high right now because there've been a couple incidents lately and there was trolling and name calling. The VAST majority of people on this board are supportive and more than happy to help newbies. For example Shannon, who I've been engaging in this thread, has forgotten more about face painting than most of us will ever know. And she is SO generous with her expertise about techniques and brands and everything.

As with anything, there are people on both ends of the spectrum who go too far, but it's mostly common sense. Don't use anyone else's photos without permission and don't believe you have rights to all butterflies out there. If you have an issue with someone, handle it like an adult.

I hope to get to Columbus for a meeting... I have a two year old and a husband who thinks my absence will cause a catastrophic shift in the universe. I have been swamped on weekends and my house is still.recovering. I still.plan to get to one in the future

Ahh, that's the bit I was confused about. I knew he'd had problems with a couple of companies or artists (the vast majority apparently love that he's doing the parody, and it's been said some see it as an "I've made it!" thing Very Happy ) but was fairly sure he'd not actually been sued. Smile

I found the Coolio thing ridonkulous given that the song Coolio wrote was based on another song by Stevie Wonder. Perhaps Stevie should've served papers to both of them. Wink

Forums work so much better when people stick to the "Talk about myself" rule. Only ever address your ideas and what you think without every mentioning another poster's name, etc. Make the post about you, say what you have to say once, (Here's my two cents on the topic) and be done with it.

Exception: If what you are about to say meets the Should I say It Test. Is it complimnetary, Is it absolutely true, Is it Kind, Is it Neccesary?
